Primary topic: Islamic home finance offer to purchase South Africa

The offer to purchase and the finance documents are separate, but their deadlines and assumptions must work together. A buyer using an Islamic finance structure should not assume a standard finance clause automatically reflects the provider’s process.

## The short answer

Before signing, obtain transaction-specific guidance on the finance condition, approval evidence, valuation, deposit, transfer sequence and deadlines. The offer must state the parties’ agreed property terms while leaving enough precision for the intended finance route to be completed lawfully.

## Identify what “finance approval” must mean

Ask the provider what written milestone confirms approval for the specific product and property. Distinguish initial eligibility, final approval, valuation acceptance and completed contractual conditions.

The offer should not depend on an undefined verbal assurance. A conveyancer can advise how to express the condition and consequence if it is not met.

## Synchronise deadlines and document order

List the offer expiry, finance application, valuation, approval, deposit, guarantee and transfer dates. Confirm which party supplies each document and whether the provider needs seller or conveyancer cooperation.

If a deadline is unrealistic, fix it before signature. Informal extensions can create uncertainty; variations should be recorded properly.

## Clarify deposits and cash contributions

Establish who receives any deposit, how banking details are verified and how the amount interacts with the provider’s ownership or funding structure. Keep transaction costs and emergency cash separate.

Never pay from emailed instructions alone. Independently verify trust-account or recipient details through an established channel.

## Review exit and default before entry

Read early settlement, sale, default, late-payment, insurance and damage provisions while there is still time to compare. Ask for worked examples of amounts where the contract permits variation.

Take unresolved legal wording to an attorney and personal Sharia concerns to a suitably qualified scholar. Do not assume the same answer applies across providers.

## Field checklist

- Provider’s approval milestones identified
- Offer finance clause reviewed for the specific route
- All deadlines placed on one timeline
- Deposit destination independently verified
- Total acquisition cash calculated
- Exit and default provisions understood

## Mistakes that weaken the decision

- Equating pre-qualification with final approval
- Using a conventional clause without review
- Missing a deadline while waiting for provider documents
- Paying a deposit to unverified banking details

## Turn the research into a next step

Keep one property-specific decision file containing the listing facts, questions, source documents, quotations, professional answers and deadlines. Solace Realty can help organise the property search or selling process; legal, tax, credit and personal Sharia conclusions remain with the appropriately qualified professional.

Sellers can [request a property evaluation](/sell-your-property), while buyers can start with the area and property guides.

## Frequently asked questions

### Is pre-approval enough to remove a finance condition?

Not necessarily. Confirm exactly what the provider has approved, what remains outstanding and what the offer requires before changing or waiving protection.

### Who should review the offer wording?

A conveyancer or attorney should explain legal consequences. The provider should explain its process, and a qualified scholar can address personal Sharia questions.

### Can deadlines be extended later?

Sometimes, but an extension should be agreed and recorded properly before the original deadline creates a problem.
